Welcome to Hombie.com. By using this website, you are agreeing to be automatically bound by these terms and conditions, including our privacy policy. We encourage you to carefully read and understand these terms before using the website or any of our services. If you don’t agree, your remedy is to stop using our website.
We may update our terms from time to time and the new provisions will apply from the date they are updated.

These terms and conditions contain provisions that limit our responsibility and require both of us to resolve any disputes between us through mandatory arbitration, with no jury.

1. Definition of Terms
“We, “our” and “us” refer to Clearwater Corporation QLD Pty Ltd atf EQB Trust tas Hombie.
“I”, “you” and “your” signifies you are a member or pre member who uses the platform in any way by accessing the website or any services.
“Account” An account must be opened with us to allow an individual, couple or family to become a member and access the services offered by the platform.
“Host Member” signifies a member who offers their accommodation as part of an exchange or swap. They are the host of the premises.
“Guest Member” signifies a member who enters into an exchange or swap with host member. They are the guest of the premises.
“Member” you become a member by purchasing a membership to the Hombie service. Whether annually or a one-off membership.
“Pre Member” signifies a person, couple or family who signs up to the platform, and by doing so agrees to these Terms and Conditions in conjunction with the privacy policy.
“Verified Member” signifies a member whose identity and accommodation has been verified by Hombie through its verification services.
“Exchange” signifies an exchange of accommodation between a host member and a guest member where points are exchanged.
“Swap” signifies a straight swap of accommodation between two members.
“Deposit” signifies a security deposit which may be required to be paid when a guest member books accommodation with a host member.
“Listing” signifies any accommodation listed on the platform by a member or newcomer.
“Hombie Points” also referred to as HP signifies the points members accumulate or are given.
“Hombie” signifies Clearwater Corporation QLD Pty Ltd atf EQB Trust tas Hombie.
“Accommodation” siginifies any permanent residential real estate that a member has the legal right to offer the platform.
“Housesitter” signifies a person, couple or family that looks after a host members property and pets as discussed in the host members listing for the period agreed on the listing.
“Sitter” or “Sit” or “House Sit” is the same as a house sitter
“Petsitter” is the same as a house sitter.
“Platform” The website, services and any future app are collectively defined as the platform
2. No unlawful or prohibited use
As a condition of your use of this website, you warrant that you will not use this website for any purpose that is unlawful or prohibited by these terms and conditions. You may not use this website in any manner which could damage, disable, overburden, or impair this website or interfere with any other party’s use and enjoyment of this website and service. You agree not to hack into areas of this website that are not intentionally made available to you.
You expressly agree not to:
a) use the website as a lead generation tool for the benefit of your own business, or to manufacture “lists” in order to help your own business, without our prior approval
b) engage in any internal or external spamming, or other similar actions
c)upload or transfer files that contain viruses, corrupted files, malicious code or trojan horses or any software or programs that may damage the operation of or gain unauthorised access to another person’s computer.
d) Use spiders, bots or any other scrapers to collect information of any sort from the platform.
e) engage in any unlawful or immoral acts, or acts which are in violation of these terms and conditions
f) decompile, reverse engineer, or try to copy or imitate this website or underlying content in any way.
g) provide false or misleading information when creating an account or to any member or us.
h) create multiple accounts or false accounts.
i) Post on the platform, or transmit to others any communications or material that is defamatory, offensive, sexual in nature, threatening, inaccurate, abusive, racist, harassing, illegal or any material that infringes or violates the rights of any other party.
j) Offer any accommodation for monetary benefit. Ie rent
k) Interfere with any other members accounts or listings in any way.
l) Collect, obtain or use information about other people including email addresses, or any contact information without their consent.
m) Use the platform to violate any applicable law that exposes a member or us to any threat of civil or criminal penalties.
n) Carry out any activity on the platform to receive a payment from a third party without the express authorization of Hombie.
o) Exchange accommodation outside the platform when that accommodation is listed on the platform.
p) Not to offer any accommodation for monetary benefit. Ie rent
q) Not to interfere with any other members accounts or listings in any way.
r) Collect, obtain or use information about other people including email addresses, or any contact information without their consent.
3. General Use of the Platform
Your use of the Platform is conditional on your compliance with these Terms and Conditions
When using our platform, you agree;
a) Comply with all rules and prohibitations in these terms and conditions and privacy policy.
b) Members and pre members are only allowed to use the Platform if they are at least 18 years old and are able to enter into legally binding contracts. If you are not over the age of 18 you are not permitted to be a member in any capacity on this site.
c) Your choice to host, exchange, or travel is entirely your own. Government agencies may issue travel advisories for certain countries or regions, highlighting safety concerns, crime, or other potential risks. It is your responsibility to review these advisories before traveling. Hombie is not responsible for when or how you travel.
d) Members and Newcomers are solely responsible for identifying and complying with all applicable laws, regulations, and requirements when offering their accommodation for an exchange. This includes determining whether licenses, permits, or registrations are necessary before proceeding. Hombie does not provide legal advice. Therefore, individuals should seek independent legal counsel if they have any compliance-related questions.
e) Our platform will eventually operate in most, but not all, countries, and certain restrictions may affect its availability. You agree to comply with Australian and US export control laws, as well as any applicable export regulations in your local jurisdiction. By using our platform, you represent and warrant that:
- You are not located in, nor a citizen of, any country or jurisdiction subject to Australian or U.S. government sanctions, embargoes, or designated as a state sponsor of terrorism.
- You are not, and have never been, listed on any Australian or U.S. government sanctions, restrictions, or prohibited parties lists, including the Specially Designated Nationals and Blocked Persons List maintained by the U.S. Department of the Treasury and the Australian Treasury Department.
f) You assume full responsibility for your use of all information on the platform
g) You are solely responsible for your communications and relationships with other Members.
h) Any web address or URL must receive prior approval from Hombie. Email addresses and other contact information may only be included in approved sections of the listing. All other references to specific web addresses, websites, email addresses, or phone numbers may be removed without prior notice.
i) Please note that Hombie cannot guarantee the accuracy of the translations provided. Members are responsible for verifying the accuracy of the translations and all information, images and data for their listings.
j) Hombie reserves the right, but is not obligated, to monitor the use or access of the platform to ensure the safety of Members and Newcomers, as well as to ensure compliance with these Terms and any applicable laws, regulations, or legal orders. Members and Newcomers agree to cooperate in good faith with Hombie by providing any relevant information and taking any reasonable actions requested by Hombie in relation to any investigation, whether conducted by Hombie or a legal authority, concerning the misuse of the platform.
4. Membership Rules
a) You must be 18 years or older to register for an account
b) You are not permitted to allow others to use your Account, nor may you use it for the benefit of third parties (e.g., registering an Exchange on behalf of a friend or an individual outside your household). Unless expressly authorized, you may not transfer or assign your Account to any person or entity.
c) Each household is permitted to create only one Account. Any exception to this rule will require prior written approval from Hombie. You may designate adult members of your household as authorized users of your Account at your discretion.
d) Members must keep their account and listing up to date at all times.
e) No account may be created for business or commercial purposes unless approved by Hombie.
f) Any account created in violation of these Terms and Conditions will be subject to immediate suspension and or termination.
g) We reserve the right, at our sole discretion, to deny the registration of an Account for any Member at any time, without obligation to provide justification, recourse, or compensation.
h) Members are solely responsible for maintaining the confidentiality of their login credentials and for any activity on their Account, including unauthorized use by third parties. We are not liable for identity theft or fraudulent account use. If a member suspects unauthorized access, they must notify us immediately. In case of lost or stolen credentials, the member must promptly update them and assumes full responsibility for any resulting damages.
i) Members are independent parties and shall not be considered employees, agents, joint ventures, or partners to or with Hombie for any purpose. They act solely on their own behalf and not on ours. We do not control or direct Members in any manner, and each member acknowledges that posting an Ad or participating in an Exchange is entirely at their own discretion.
5. Account Verification
When an account is created by a new member, the Hombie team will verify the name, address, telephone number and email address.
a) Hombie reserves the right, in its sole discretion to accept or reject supporting documentation provided for verification.
b) Hombie provides a verification service to verify the name and address of each Member they create an Account. All Members must provide proof of address and a form of identification to verify their address and identity.
c) Once a member has been verified, the member is designated “Verified Member” on their profile and the member can participate in exchanges, swaps and house sits.
d) Hombie does not provide any guarantees or assurances regarding verified members or their listings nor do we guarantee accuracy or authenticity of any content and listings.
e) Members will still need to do their own due diligence on a member they are hosting.
6. Listings
a) Listings must be kept current and accurate at all times
b) An accommodation can only have one listing. It cannot be listed multiple times.
c) Hombie makes no guarantees as to the position of a listing in search results. This is due to multiple factors and which keywords a guest member is searching with.
d) All Members represent and warrant that posting a listing and accepting an exchange for a host member’s accommodation will not breach any agreements with condominium associations, homeowners associations, cooperatives, body corps or similar entities. Additionally, they confirm compliance with all applicable laws, including zoning regulations, tax obligations, licensing, and permit requirements. Host Members are solely responsible for their actions and omissions, as well as those of anyone present in the accommodation, except for the guest member and their guests.
e) Hombie reserves the right to require minimal information and images be included in all listings
f) Listings are to follow Hombies listing format unless previously authorised to change the format.
g) Host members are responsible for the accuracy of their listings location, information, images and anything else that is required to inform potential guests on the accommodation. False listings in any part can be removed from the platform at Hombies discretion.
h) Host members are responsible for informing members of any outdoor security devices. This includes alarms, cameras, video surveillance etc.
i) Indoor surveillance cameras, recording devices or video surveillance are not permitted.
7. Closing an Account by Hombie
a) If a Member violates these terms and conditions, any platform rules, or engages in conduct that conflicts with our standards of good conduct, values, or ethics, or breaches any applicable law, regulation, or legal order, Hombie reserves the right, at its sole discretion and without obligation to provide justification or compensation, to:
- Restrict the Member’s access to the Platform,
- Remove any User Content hosted on the Platform, or
- Terminate the Member’s Account.
b) We reserve the right to close a Member’s Account without prior notice. Account closure due to a violation of these Terms does not waive our right to seek any applicable damages resulting from the violation.
c) If a member’s account is closed due to a breach of these terms, their membership will be terminated immediately without eligibility for a full or partial refund.
d) We reserve the right to deactivate, terminate, or delete your account, including all associated listings and related information, if you remain inactive on the platform for a period determined at our sole discretion. This is so we can keep the platform clean and up to date.
8. Closing of an Account by a member
Members may terminate their registration on the Platform at any time for any reason by requesting account closure. No fees apply. The following conditions apply.
a) The member shall not have any home exchanges, house swaps or house sits booked for the period of the membership.
b) Membership fees will not be reimbursed in part or in full after the 14 day cooling off period. If the account is closed within 14 days of paying membership fees the full amount is reimbursed.
c) All Hombie points accrued by that member will be forfeited.
9. Services that Hombie Offers
The Hombie service is limited to the following
a) The management and execution of home exchanges, house swaps and house sits.
b) Verifying members
c) Messaging service
d) Allocation and management of Hombie points
e) Deposit management when required
f) The following services if required are managed and financed by third party operators
- Insurance, cleaning, car rentals, monitoring.
10. Management of Home Exchanges, House Swaps and House Sits
Hombie offers a home exchange, house swap and house sit management service through its platform, enabling host members to list their accommodation for exchange, swap or house sitting and guest members to browse listings and reserve available accommodations.
a) Hombie serves solely as a platform connecting members and does not participate in the contractual agreement between them. When members engage in an exchange, swap or sit they do so independently, without Hombie acting as a party to the transaction.
b) Hombie is not a real estate broker, insurer, or agent for any member, except as explicitly stated in these Terms and Conditions. The exchange management services provided are fully automated, and all interactions between members occur solely through their own efforts, without Hombies involvement, except where expressly indicated.
c) Hombie does not guarantee the legality or proper execution of any exchange, swap or sit between members. Additionally, Hombie makes no assurances regarding the availability or condition of the accommodation, nor any terms set by one member for another as part of an exchange, swap or sit.
d) Members who choose to engage in an Exchange through the Platform do so voluntarily and assume full responsibility for their participation.
e) Each Exchange, swap or sit grants the guest Member or house sitter a limited authorization from the host member to enter, occupy, and use the accommodation for the agreed upon period. Subject to applicable law, the host member retains the right to re-enter the accommodation under the terms of the specific exchange agreement.
f) Members assume full responsibility for any risks associated with providing or occupying an accommodation as part of an exchange, swap or sit including potential property damage or theft of furnishings.
g) Guest Members are solely responsible for the actions and omissions of all individuals present at the accommodation, regardless of whether they have been disclosed to the host member. All guests must adhere to the host member’s rules and requirements and comply with these Terms.
h) Guest members must not accommodate or invite anybody to the accommodation without the hosts approval.
i) Host Members have sole discretion in selecting a Guest Member for their Accommodation. Both host and guest members are encouraged to engage in preliminary discussions to address and mitigate potential issues before finalizing an Exchange.
j) Guests represent and warrant that they have the legal authority to act on behalf of any minor included in the exchange, swap or house sit. Minors may only participate in an exchange, swap or house sit if accompanied by an adult that is legally responsible for the minor/s
k) If a guest member fails to vacate the accommodation at the end of the designated exchange period, the host member may take all lawful measures to enforce their departure. The guest member agrees to compensate the host member for each additional 24-hour period of unauthorized occupancy, as determined by the host member.
l) Members agree not to arrange an Exchange for an Accommodation listed on the Platform outside of the Platform. Any violation of this policy will result in immediate account closure and loss of points.
m) Personal information, including name, phone number, and address, should only be shared with another Member when the Exchange is conducted through the Platform.
11. Hombie Points
a) Hombie points are for use on the Hombie platform only. Members can use these points to book home exchanges, house swaps or house sitters on the platform.
b) On joining as a member, Hombie allots points to the new member, this is solely at Hombies discretion and may change at any time.
c) Nightly point rates are allocated to the accommodation of new listings using the Hombie algorithm only. Members cannot allocate points to a listing in any way.
d) Hombie points do not expire whilst an account remains paid and open.
e) Hombie points cannot be purchased.
f) Transfers, Sales & Shared Accounts Are Prohibited. Points and referral credit may only apply to the individual member account. Points cannot be:
- transferred to spouses or partners,
- combined with other accounts,
- inherited or assigned,
- shared between profiles.
g) Use of Points Is Subject to Availability. Points may only be redeemed against eligible stays, upgrades, home exchange nights, or reward options available at the time of booking. Hombie cannot guarantee listing availability, booking slots, or travel dates.
h) System Errors & Adjustments. In the event of system errors, miscalculations, or technical disruptions, Hombie retains the right to correct point totals and account balances to reflect accurate data.
i) Hombie points cannot be exchanged for cash.
12. House Sitting
a) All house sitters ID and contact details will be verified by Hombie.
b) Homeowners must allocate points to be transferred to a house sitter by a nightly basis. The house sitter receives the following points per night of the house sit
- House = 20
- Per Dog = 5
- Per Cat = 5
- Fish any number = 2
- Birds any number = 3
- Per Horse = 5
- Reptiles any number = 3
- Farm animals any number = 10
- Other = Contact us at Hombie
c) The transfer of points takes place on the completion of the sit.
d) The homeowner should leave the accommodation in a clean and tidy state.
e) House sitters may accumulate points to obtain a home exchange.
f) The house sitters profile/listing should be an accurate representation of themselves with correct details and up to date images of themselves.
g) The house sitter should not have visitors or guests unless the homeowner approves.
h) If the house sitter brings unapproved visitors or overnite guests into a home without approval, the house sitter/s will be removed from the platform at the discretion of Hombie.
i) The house sitter must abide by the instructions of the homeowners house manual and listing instructions.
j) If a house sitter confirms a house sit through the platform, they must do the house sit. If they cancel, they can be removed from the platform at Hombies discretion.
k) Any damage during a house sit should be compensated between the homeowner and house sitter. Hombie is in no way liable for damage or theft.
l) The house sitter should leave the home in a clean and tidy state as they found it.
m) A house sitter must vacate the accommodation at the end of the designated house sit period. The host member may take all lawful measures to enforce their departure.
n) If a house sitter cancels refer to 15. House sitter cancellations
13. Host Member Cancellations
If a host member cancels an exchange, swap or house sit
a) Any points allotted to the host by the guest member shall be returned to the guest member.
b) Hombie may help the guest member find further accommodation but is not liable to do so.
c) If a host member cancels twice, within thirty (30) days of the expected start date of the exchange, swap or house sit without proper reason their listing will show that they have cancelled twice before. If they cancel the third time without proper reason, their account on the discretion of Hombie will be closed.
14. Guest Member Cancellations
If a guest member cancels an exchange,
a) Outside of a 90 day period from the start date of the accommodation the host member returns the points.
b) Between 30 -90 days from the start date of the accommodation the host member has the option to return the points ie if they are able to get another exchange.
c) Within 30 days of the start date of the accommodation the guest member forfeits all allotted points to the host member unless the host finds another exchange.
d) In cases of emergency, where the guest member cancels within 30 days of the start of the accommodation and provides valid supporting documentation, we may, at Hombies sole discretion, refund the points to the guest member while allowing the host member to retain the corresponding points.
15. House Sitter Cancellations
If a house sitter cancels a house sitting job after accepting the house sit on the platform the house sitter will be given one chance. If they cancel the second time (with the same member or a different member) they will be removed from the platform at Hombies discretion. Their members fees will not be re-imbursed in part or in full.
16. Cancellations by Hombie
Hombie reserves the right to cancel an exchange, swap or house sit under emergency circumstances or other situations that, in its sole reasonable discretion, are necessary to prevent harm to Hombie, any member, or any third party, or as otherwise provided in these Terms and Conditions.
In such cases, Hombie may, at its sole discretion and based on the specific circumstances surrounding the cancellation:
- refund the points to the guest member;
- allow the host member to retain all points associated with the Exchange;
17. Members Referral Program
The Hombie Referral Program is designed to reward our members for introducing new paid members to the platform. Participation in this program is completely optional. By participating, members agree to the following terms and conditions:
a) Program May Change at Any Time. Hombie reserves the right to amend, suspend, alter, or cancel the referral program, point values, earning structure, bonus amounts, qualification criteria, or reward levels at any time without prior notice.
b) Points Are Not Guaranteed. Point totals, valuation, earning rates, thresholds, and bonus levels are not guaranteed now or in the future. Points and earning structures may increase or decrease at the sole discretion of Hombie and may vary on a year-to-year or promotional basis.
c) Points Have No Cash Value. Unless otherwise stated for Platinum and Executive Members, points do not constitute currency, do not accrue interest, and cannot be sold, transferred for cash, traded, gifted, or redeemed outside permitted uses on Hombie.
d) Membership Required to Maintain Points. All points earned remain active only while the referring member maintains a paid, current membership. If a membership expires, is cancelled, suspended, or terminated, all points attached to that account will be permanently forfeited.
e) Referral Eligibility. Referral points will only be awarded when:
- the referred user becomes a fully paid member,
- is not already in the Hombie database,
- has not been referred by another member, and
- has successfully completed the payment process.
- The referred members accommodation meets the set minimum nightly point value. The set point values are
- Houses 180 points
- Townhouses/semi detached houses 150 points
- Apartments 120 points
f) Hombie reserves the right to reject referrals that appear fraudulent, duplicated, or self-generated.
g) Active Member Requirement for Bonuses. Bonus rewards tied to milestone achievements (e.g., 100 active referrals for Platinum or higher status) require those referred members to remain active and paid at the time of review. If referral counts drop below the required level, bonus eligibility and status may be removed or changed to correct bonus level.
h) Annual Earnings May Vary. Any annual point payouts or referral based income require continuous eligibility. If a member falls below the required referral count, annual rewards cease until such requirements are met again.
i) Account Reviews & Audits. Hombie reserves the right to audit referral activity, point earnings, account relationships, and eligibility data at any time.
Accounts linked to fraudulent referrals or manipulation will lose points and may face membership termination.
j) Status Levels Are Not Permanent. Elite member statuses (Bronze, Silver, Gold, Platinum, Executive) require ongoing qualification criteria and may be revised or removed at any time.
k) Program Fair-Use Policy. Members may only refer genuine new customers who join voluntarily. Any attempt to mass-register fake users, create duplicate identities, or exploit the referral system will result in disqualification from the program and termination of their account.
l) Legal & Regulatory Compliance. Program participation must comply with local laws, tax obligations, and advertising rules in the member’s region. Hombie will not be responsible for tax liabilities on point value or referral income.
m) Termination of Program. Hombie may discontinue the referral program without compensation or replacement rewards. Points earned before termination may remain usable, subject to ongoing membership, or be cancelled if the program is withdrawn.
n) Acceptance of Terms. Participation in the referral program automatically constitutes acceptance of these terms and any future amendments. Continued use of the program after changes indicates ongoing agreement.
18. Refunds
If members are due a refund which has been authorized by Hombie, the refund will be issued by the payment method used by the member no later than twenty business days from the date of cancellation. This is provided there are no exchanges, swaps or sits reserved on the account.
If an account is closed for any reason membership fees will not be reimbursed in part or in full after the 14 day cooling off period. If the account is closed within 14 days of paying membership fees the full amount is reimbursed.
19. Inaccurately Described Accommodation
If listing information inaccurately describes the accommodation
a) Notify the host and add the inaccuracy into your review.
b) Notify the Hombie team who will request the inaccuracies are rectified or the listing changed to accommodate the correct information in the listing
c) If the requests are not actioned in a time frame deemed to be acceptable by Hombie and the same inaccuracy is notified by the next guest, the account will be removed from the platform.
d) If the accommodation is found to be not liveable by a guest, Hombie will endeavour to find more suitable accommodation for the affected guest. Hombie will not be held reliable in any way for the standard of the accommodation. Factors that determine whether the accommodation is liveable are; no electricity, no running water, no hot water, no toilet or functionable toilet, no refrigerator or its not working, no functional cooking units, no bathtub or shower in working order, significant presence of pests, leaking roof into the interior living areas, no way of heating or cooling, declared as suitable for disabled when its not, no adequate access once inside the building.
20. Messaging Service
Hombie offers members a messaging service to facilitate Exchanges and share experiences from past Exchanges. However, the use of this messaging service alone does not allow members to establish or finalize an exchange. As the messaging service operates in an automated manner, Hombie remains uninvolved in communications between users.
Members are solely responsible for the content of their communications through the Hombie messaging service. Hombie is not bound by any information exchanged between users and does not guarantee the accuracy or completeness of such information.
21. Ratings, Responses and Reviews
After the exchange, swap or sit is completed
a) Hosts may provide a review and or rating to a guest or sitter and a guest or sitter may also provide a rating and or review for the host. Only one from each is accepted. These reviews and ratings will be posted on the appropriate listings/profiles.
b) A review or rating cannot be issued if the exchange, swap or sit did not take place.
c) Users are unable to remove a Review, Rating or Response even if they disagree with the content.
d) Hosts, guests and sitters must provide true, fair and accurate information in their reviews, ratings and responses. These reviews, ratings and responses reflect the opinions of individual users and do not reflect the opinion of Hombie.
e) Hosts, guests and sitters have a period of 14 days after the completion of the exchange, swap or sit to leave a review and rating. If all parties involved have left their review or/and rating within the 14 day period the information will be posted for all to see. Otherwise if only one party reviews or rates the information will be shown after the 14 day period.
f) Reviews, responses, and ratings represent the opinions of individual members, and Hombie does not verify or guarantee their accuracy. Members agree to provide only truthful, non-defamatory, and respectful content in their reviews, responses, and ratings. Such content must not be used for extortion or coercion. Additionally, members are prohibited from soliciting or posting false reviews, responses, or ratings.

i) Hombie does not undertake to screen each Review, Rating or Response but will monitor them periodically.

22. Insurance
a) Host members are solely responsible for obtaining and maintaining valid homeowners, renters, or other legally required insurance related to an exchange, swap or house sit and any associated equipment. This insurance must remain active throughout the duration of the exchange, swap or house sit. Failure to maintain adequate coverage may result in the immediate termination of the host member’s account.
b) Additionally, Hombie reserves the right to request proof of insurance and any relevant supporting documentation. Failure to respond or provide accurate information may lead to the cancellation of the member’s account.
c) Members are responsible for reviewing and understanding their own insurance coverage, as well as the coverage held by any member with whom they participate in an exchange, swap or house sit, including property and liability insurance. Each member remains solely liable for any violations of their insurance agreements or policies resulting from their participation in an exchange, swap or house sit.
